2010 Transport Year. Events and Practice

The third annual workshop traditionally organized by International Law Offices in December for parties to the transport process was held on 16 December 2010, Odessa. The partners of the event were association ‘Ukrvneshtrans’, journals ‘Transport’ and ‘Ports of Ukraine’.

 

Considering various transport events of this year, the organizers have decided to enlarge the scope of the workshop covering different actual problems and issues of the parties to the transport process. ‘Transport Year 2010. Events and Practice’ was the name of the discussion at the workshop this year.

 

The workshop for forwarders gathers the audience for the third time and this year there have been more than 40 delegates from various cities of Ukraine and near abroad.

 

The participants were the specialists from leading forwarding and logistics companies, representatives of the cargo owner companies, container lines, insurers and carriers.

 

Moderators of the workshop, senior lawyers of International Law Offices, Artem Skorobogatov and Natalia Myroshnychenko, covered the main events of the year in transport sector and highlighted the most actual and burning issues based on everyday practice of International Law Offices in 2010.

 

The issues that laid the basis for the discussion and exchange of views were as follows:

- actual issues related to the Bill of Lading;

- general averages in 2005-2010;

- liability of the forwarder under FCR and forwarder’s liability insurance;

- consequences of unpublished customs prohibitions;

- basic world transport tendencies etc.

 

A vivid discussion was raised practically from the very beginning as the participants were very active. Each of them tried to speak on the subject and to share their problems having been recently appeared in transport business as well as the ways for their solutions.

 

Roman Koloyanov (Maersk Ukraine), Vladimir Babilunga and Alexander Katerynchak (Duke Active) took an active part in discussion of the issues related to execution of the Bills of Lading and attendant problems. The comments as for the carrier’s liability were given by Anna Snegur (DHL International Ukraine).

 

The discussion became more active when covering the issues on intercourse with the customs. Similar issues were discussed by Alexander Schekin (General Director of CMA CGM Ukraine), Alexander Zakharov (Director of AT Promtex), Alexander Lazarev (Damko Ukraine) and Vadim Tereschuk (Director on Legal Affairs of HPC Ukraine).

 

The forwarder’s liability when executing FCR was interesting for the forwarders that issue their own FCR. The Deputy General Director on Legal Affairs of ‘Vara’, Yuriy Markitan, shared his experience related to that issue.

 

Andrey Rodionov (Marine Insurance Services) and Maris Purlaurs (French insurance company Groupama Transport) presented their own vision of the issues on forwarder’s liability insurance.

 

Finally the Managing Partner of International Law Offices, Arthur Nitsevych, dwelled upon the changes in transport sector that should cover the transport society next year.

 

In the end of the workshop the organizers announced the most active participants of the discussion, namely: Vladimir Babilunga (Duke Active), Alexander Schekin (CMA CGM) and Alexander Zakharov (AT Promtex).

 

The event was held in a famous Odessa whisky club Korvin where the participants tasted Scotch whisky after the workshop.

 

Cosy club being favourable for communication, vital and actual issues for the discussion and active participants created the atmosphere of that event.
