Infrastructure PPPs in Eastern Europe, Caucasus and Central Asia: forum in Kiev

Interlegal Partner Arthur Nitsevych and Ports & Maritime Project Manager Rachid Bouda participated in the conference “Infrastructure PPPs in Eastern Europe, Caucasus and Central Asia” held in Kiev on September, 14.

The forum gathered the leading Ukrainian and foreign investors in port industry, state authorities’ delegates and PPP experts in infrastructure.

First, TIS Company and the Ukrainian Sea Ports Authority signed the Memorandum of Understanding, under which USPA undertook to dredge the approach channel towards TIS terminals, while TIS got engaged in dredging works near the berths.

Taras Boichuk, SPILNO Project Office Manager, presented a report about drafting Feasibility Study by state port operators of Stevedoring Company “Olvia” and SE “Kherson Commercial Sea Port”.

Mr. Boichuk noted, “Stevedoring Company “Olvia” will be subject to 35-year concession. Requirements for investments: nearly 60 million USD for constructing a new grain terminal for handling 2 million tons per year. There will be an option for fixed or variable concession fees: the first payment type will depend on dividends paid in 2015-2017, while the second one will become clear at the tender stage. As for Kherson Sea Port, jointly with some other assets, it will be subject to 30-year concession. Requirements for investments: up to 10 million USD. Social duties will be the same as for Olvia. Tender will be announced by the end of this year”.

On September 5, principal conclusions of Feasibility Study regarding concession of state port operators – Stevedoring Company “Olvia” and SE “Kherson Commercial Sea Port” – were presented to trade unions and representatives of local authorities. Feasibility Study was drafted in October-November 2018 by the International Advisers Consortium, with Interlegal engaged as MTBS Ukrainian partner.
