Interlegal participated in the UBA Committee on Transport Law

The UBA Committee on Transport Law held a meeting “Vital legal issues of transport industry” on May 31, 2016. Discussion touched the following main issues:

 

- Practical aspects of SOLAS implementation by Ukraine in respect of loaded container weighing;

- Development of new port duty calculation procedure;

- Proposals upon amendments to Regulation of damage calculation and reimbursement due to pollutions from vessels and other floating crafts at inland and territorial waters of Ukraine approved by the Order of the Ministry of Environment No. 116 dd. 26.10.1995.

 

Arthur Nitsevych, partner of Interlegal, and Alexey Remeslo, senior lawyer, participated in the committee. The discussed issues are important for the whole marine industry in particular for port society. Special guests were Vyacheslav Voronoy, Deputy Head of SE “Ukrainian Sea Ports Authority” in logistics, and Vadim Tereshchuk, Deputy Head of State Ecological Inspection in North-West Region.

 

The first issue is essential, in particular, for container ship navigation safety, since wrong determination of container general weight may result in marine casualty. Container ship safety shall be facilitated by verification and determination of verified gross mass (VGM).

 

Damage calculation procedure in respect of sea pollution due to oil product spillage from vessels requires for serious updating. There are some practical problems, since the Ukrainian ecological bodies accept neither opinions of world-known surveyors nor guarantees of worldwide P&I clubs recognized as security of shipowners’ responsibility.

 

The issue of lifting the sunken property has been proposed for discussion at the next meeting of the Committee.
