The client applied to Interlegal for consulting upon taxation and business activity in Ukraine regarding the company incorporated by a foreign entity.
In the process of consulting, Interlegal corporate lawyers analyzed the following two groups of questions:
1. General terms and taxation procedure on the company’s activity in Ukraine. It included, inter alia, analysis of taxation procedure on foreign founder’s income (dividends) and procedure of cost remittance abroad with regards to the currency restrictions.
2. Business activity of the company director, competing with the company’s activity. It included, apart from tax aspects upon business activity of the natural person – entrepreneur and peculiarities of cooperation with foreign customers, analysis of the concept of correlated persons and regulations of the new Law of Ukraine “On Limited and Additional Liability Companies” dd. 06.02.2018 regarding officers.
This analysis facilitated recommendations concerning optimal form of the company for activities in Ukraine, from the taxation aspect.
