Interlegal lawyers succeeded in case settlement upon reimbursement of lose cargo value, due to accident.
In the process of fertilizer carriage by sea from Turkey to Ukraine, a leakage was found in the vessel hull, so one of the holds was flooded and over 2,000 tons of cargo were irretrievably damaged by water. The vessel terminated her voyage and returned to Turkey for emergency repair, while the shipowner announced general average and appointed an average adjuster. The surviving cargo was discharged to the customs warehouse.
At the first stage, Interlegal lawyers entered into negotiations with the Turkish shipowner and the P&I club, contested the calculation of general average premiums, obtained the P&I club guarantee and provided legal support for signing an amicable agreement between the cargo owner, the shipowner and the insurer.
At the second stage, Interlegal lawyers provided legal support to the client in further delivery of the surviving cargo to the destination place, jointly with customs clearance procedures in Turkey and issuing the documents certifying general average and cargo loss, to be submitted to the Ukrainian regulatory bodies. The process resulted in full reimbursement of lose cargo value by the P&I club.
Interlegal senior associate Andrey Perepelitsa, jointly with Istanbul office, led the case.
