Detention of a vessel in Izmail port: from complaint to order in one hour

Recently, a charterer Client contacted Interlegal with a request to detain a vessel in the Izmail port.
The amount of the maritime claim against the shipowner was small – about 7,000 US dollars. However, for the charterer it was of crucial importance, as the subject of the claim was the shortage of cargo in a gaseous state, systematically recorded during the unloading of the cargo.
Considering the vessel’s short stay in the port, the Interlegal team began work without delay and promptly sent the client a list of necessary documents. After receiving the documents, an Interlegal specialist translated them into Ukrainian within a few hours, and the legal team prepared a statement on the detention of the vessel.
After sending the statement, a representative of the project team urgently contacted the port captain. During lengthy negotiations, all arguments in support of the corresponding statement were discussed. As a result, Interlegal succeeded in proving the legality and validity of detention.
Accordingly, within an hour an order to detain the vessel was received, which resulted in the start of active and detailed negotiations between the charterer and the shipowner on the merits of the dispute.
Approximately 24 hours after the vessel was detained, the parties reached an agreement on the settlement of the conflict on mutually beneficial terms. The Client then issued an urgent task — on a day off — to cancel the detention of the vessel.
Within a few hours, the team drafted and sent an application to cancel the tanker detention, and also monitored the process of issuing the relevant order by the captain’s office.
The fruitful work of the experienced team and their immediate response to all the Client’s requests on the case helped ensure that the Client reached agreements with the shipowner on acceptable terms and resolved the conflict.
