Force majeure: critical view

The Client applied to Interlegal for assessment of presence / absence of force majeure in the framework of its contractual relations.
Having studied text of the agreement, special legislative and other regulatory acts, Interlegal lawyers drafted for the Client a legal opinion which recommended, inter alia, critical attitude to evidence of force majeure.
To eliminate such critical circumstances, lawyers recommended compliance with terms set forth in the agreement with counteragent, in respect of notifying on force majeure, followed by immediate application to the Ukrainian Chamber of Commerce for issuing the appropriate certificate.
The Client obtained work flow chart and necessary instruction aimed to defense of its business activity against unforeseen claims and expenses and accounts payable.
