We have repeatedly indicated that international road transport is becoming increasingly important in the current circumstances.
Our Client, a Polish freight forwarding company, also recognized this trend and applied to Interlegal to prepare a contractual basis for its new direct operation: road transportation Lithuania-Poland-Ukraine.
Our lawyers promptly drew up the following contracts for the Client:
1. Freight Forwarding Contract (truck transportation) whereunder our Client is the Forwarder and the Lithuanian company is the Customer. The Contract is governed by Lithuanian substantive law and covers all nuances of the forwarder’s cooperation with road transport in the European Union.
2. Road Transportation Contract whereunder our Client already acts as the Customer for the Ukrainian carrier’s services. The Contract conforms to international law and is governed by the substantive law of Ukraine.
Working on a contract is always a step forward, especially if the client is considering a new activity. To anticipate threats that the business has not yet dealt with and to neutralize them with a professionally structured agreement means to protect the company against unfair counterparties and losses in future.
When developing proforma contracts for each client, Interlegal lawyers carefully analyze not only local legislation norms, but also business processes, conditions and factors that affect the company’s work. An individual approach helps to re-identify potential risks, to identify unobvious controversial situations and unregulated issues the Client’s activity may face.
As a result, the Client obtained proforma contracts that maximally reflect its interests and mitigate risks during organization of road transportation in cooperation with the service customer and the actual carrier. In future, proforma contracts will help companies to significantly speed up and to simplify the process of drawing up contracts and to reduce costs for further legal support.
Interlegal lawyer Olesia Ivanova and associate attorney Dmytro Ochkolias, managed by associate partner Karyna Gorovaya, led the case.
