In case of opening non-resident companies by means of various options, a key aspect is the clients’ desire to defend their own interests and to obtain certain guarantees.
Interlegal lawyers provided appropriate legal advice for the Client with legal mechanisms for defense of non-resident company owner.
Instruments for defense of owner’s interests can be the following: English Law Contract on certain terms and personal guarantee.
The Contract is valid and is governed by English law. It sets out provisions fixing clear rights and obligations of the Parties, while in case of violations it prescribes loss recovery and certain liability. Under such Contract, the Parties’ interests may be defended by appropriate arbitration court.
Personal guarantee shall be signed for avoidance of violating certain obligations against the owner.
One more defense instrument may be restrictions by the company officers under the Articles of Association.
