Interlegal continues to consult actively upon the issues of trade financing, pledge on goods and payment against FCR

The Client, one of leading foreign exporters of metal products from Ukraine, applied to Interlegal for advice upon trade financing, arranging of pledge agreement on goods and risk minimization under payment against FCR.
Having studied the issue, Interlegal experts made a complex analysis of the national legislation and international practice concerning issuing and using FCR under the goods supply for export on EXW/CPT/FOB/CIF terms from Ukraine and organization of its full payment before shipment on board of the vessel.
Special attention was drawn to the proposed scheme of trade financing and use of the pledge on goods as a mechanism of defending interests of the Client and its financial party. In particular, the Client received practical recommendations regarding conclusion of the pledge agreement as a security for non-monetary obligations, the opportunity of two pledgees or pledgers and differentiation of their rights, as well as organization of pledge of goods in trade and transfer of title to such goods.
