Interlegal defended yacht owner’s interests under the dispute with equipment supplier

In the framework of Interlegal yachting practice, the Client applied for defense of its interests under the dispute with the Greek manufacturer, while the latter delayed manufacturing and supply of deck equipment to the yacht.
Interlegal analyzed in details both the contractual term and the supporting documentation (quotations, specifications, invoice).
Supply process was governed by the manufacturer’s expanded Terms&Conditions published at the company official website. Such Terms&Conditions supplemented the Contract and prevailed in case of discrepancies.
The Contract provided also much freedom for the manufacturer in fixing manufacturing and supply terms, i.e. without fixed final performance date. In order to defend the Client’s position, Interlegal lawyers joined longstanding negotiations with the supplier, which resulted in drafting the supplement to the Contract, whereunder the supplier undertook to manufacture and to supply equipment within the fixed term.
