Interlegal dissolved marriage registered in Montenegro
In the framework of Personal Attorney Service practice, the Client – citizen of Ukraine – applied to Interlegal for marriage dissolution between our Client and the citizen of Russia.
Case specification was that the marriage was registered in Montenegro, while our Client lives in Ukraine and his wife’s location was unknown.
De facto the spouses lived together not more than a month; due to discrepancies they ceased to live together, however de jure their marriage lasted for 5 years more.
Since marriage preservation was not in the Client’s interests, he applied to Interlegal for legal assistance.
Interlegal lawyers analyzed the situation and developed action plan and legal position on the merits.
In the present case, there were 2 stages of work:
1. To obtain marriage documents in Montenegro. For divorce, it is necessary to provide to the court the original marriage certificate, however the Client did not have it.
2. To dissolve marriage by the court.
Interlegal lawyers, jointly with associated office in Montenegro, obtained marriage documents (in Montenegro, instead of Marriage Certificate typical of us, the Extract from the Marriage Register shall be issued).
Based on the developed position and the obtained documents, Interlegal lawyers filed a statement of claim with the court under the Claimant’s location, i.e. in Ukraine, defended his position in court, overcame the judge’s doubts, having submitted all the necessary documents, which resulted in positive court decision.
