Interlegal lawyers facilitated avoidance of quality dispute

Having applied to Interlegal in due time, the Client, acting as the Seller under the Sales Contract, prevented dispute upon supplied goods quality, at the stage of cargo sampling at the loading port.
The Buyer’s surveyor detected visually the goods non-conformity to contractual quality and rejected further sampling procedure. In turn, the Buyer provided instructions to suspend loading, until amendments to the terms for determining goods quality (loading port replacement by discharge port) are approved by the Seller.
Interlegal lawyers engaged promptly in the process of negotiations with the Buyer regarding their surveyor’s position. Having studied in detail the Contract provisions on the goods quality, including on terms for joint sampling by both Parties’ surveyors, Interlegal lawyers justified unlawfulness of the Buyer’s positions and its surveyor’s actions. As the result, the Buyer agreed to continue loading jointly with sampling procedure, in accordance with the Contract and without any claims. Therefore, the Seller facilitated successful performance of the Contract under initial terms.
