Interlegal lawyers facilitated cancelling decision of State Environmental Inspection by the court

Interlegal lawyers, acting in the defense of foreign shipowner’s interests, asked the court to recognize as unlawful and cancel the above of State Environmental Inspection on the vessel prohibition to leave the sea port water area due to causing damage to natural environment and non-payment of fines or claims for breach of the Ukrainian legislation on natural environmental safety.
Case specification was the following. State Environmental Inspection detected once more the fact of contaminating inland territorial waters, filed a claim against the Shipowner upon accrued damage recovery, followed by making a decision on the vessel prohibition to leave the sea port water area. But the harbour master granted permission to leave the sea port water area, based on the Shipowner’s Letter of Guarantee, without payment of State Environmental Inspection’s claims.
Later, in order to eliminate the following risks concerning the Client’s business activity, Interlegal lawyers applied to administrative court on recognizing as unlawful and cancelling the above decision of State Environmental Inspection.
Despite active counter-actions of the opposing party, the court supported Interlegal position and satisfied claims in the Shipowner’s interests.
