A Client apply to Interlegal for refund of costs on travel to exotic country – naturally being cancelled due to closing borders and cancelling air flights in order to prevent spreading COVID-19.
Travel operators usually propose four options:
– to postpone travel;
– to book a new travel, with payment shifted thereto;
– to freeze funds and to use them as payment for booking in future (deposit);
– to cancel travel.
Of course, the latter option is the least attractive.
Case specification was travel cancellation for less than one week before commencement, resulting in high penal sanctions imposed on the Client.
Interlegal team promptly analyzed the current agreements and documents, filed a letter of request for travel cancellation and mitigation of penal sanctions and joined negotiations.
Travel operator supported arguments of Interlegal lawyers and confirmed cancellation of travel with minimum penal sanctions, followed by cost refund.
Interlegal lawyer Nikita Kocherba, managed by associate attorney Ellina Romanova, Personal Attorney Service, led the project.
