Interlegal lawyers settled the dispute concerning the Terminal unlawful rejection to hand over the cargo

The large Ukrainian trade filed a request to Interlegal on legal assistance due to the Terminal unlawful rejection to hand over the cargo.
Case specification was absence of direct contractual relations between the Client and the Terminal: they cooperated solely via the Forwarder under Freight Forwarding Agreement which prescribed for soybean delivery to warehouse for storage. Despite instructions upon shipping and vessel nomination before vessel arrival for loading, the Terminal in the person of the Forwarder rejected preparing cargo for loading, with reference to formal reasons.
Despite oral agreements, with regards to all recommendations of the Terminal, cargo shipment was rejected one day before vessel arrival.
Having analyzed documents and situation, having assessed lawfulness and feasibility of the Terminal rejection, Interlegal lawyers drafted legal position followed by claims handling in respect of the Forwarder and the Terminal. Interlegal experts facilitated not only the dialogue with counterparties (the Client was unable to achieve it individually) but also dispute settlement. Due to prompt and fruitful teamwork, the cargo was handed-in to the Client within two days.
