The Ukrainian grain supplier engaged in large-scale international business applied to Interlegal for debt recovery from the Buyer (British Company) under the foreign economic contract, jointly with demurrage and penalty accrued for breach of the Ukrainian law on currency control. Under the Arbitration Agreement, the dispute has been considered by the London Court of International Arbitration (LCIA).
Although at first sight the case seemed obvious – the Buyer’s non-payment for the goods, in the process of sharing arguments and evidence it turned out to be complex multi-aspect proceedings with several in-parallel disputes. There were four stages of sharing documents, high-tense procedural struggle, intermediate arbitration awards and oral hearings – all of them aimed to determine the whole case circumstances and to defend legal position. It took nearly five months to draft final arbitration award.
Due to thorough study of the case circumstances jointly with their correct legal assessment, arbitration court supported Interlegal position. Arbitration award satisfied the Client’s claims in the amount over 660 thousand USD.
Interlegal lawyer Valeria Ivanova, managed by senior associate Andrey Perepelitsa, led the case.
