Cargo arrest was imposed as claim security measure due to breach of obligations set forth in the agricultural product supply contract.
Despite the shipowner was not a party to contractual relations on agricultural product supply, cargo arrest on board of the vessel touched directly interests of both shipowner and P&I club as shipowner’s insurer.
Situation was complicated by the fact that shipowner was unable to discharge arrested cargo without assistance of two consignors, while the latters could not arrange plan of actions.
Therefore, due to absence of joint actions committed by all the consignors and shipowner, based on mutual distrust and conflict of interests (some consignors tried not to discharge cargo but to resell it to third parties), the case took quite a long time, while arrested cargo remain on board of the vessel – a sort of floating warehouse.
A complex legal assistance was provided to shipowner, namely: arrest cancellation and enforcement proceedings support, arrested cargo discharge support and arrangement of dispute settlement terms.
Interlegal legal assistance facilitated case settlement as soon as possible, with maximum security of shipowner’s interests.
Interlegal associate attorney Mikhail Selivanov, lawyer Igor Derus, junior lawyer Taras Dragan, under the general supervision of senior associate Karyna Gorovaya, led the case.
