Interlegal provided the dispute amounting to 1.3 million USD
A Client, the international global trading company, applied to Interlegal for legal assistance.
Having fulfilled its negotiations under trade contract, followed by vessel call at the seaport, it found out that most of the cargo got damaged.
At the first stage, the shipowner avoids any communications aimed at solving the situation.
As soon as Interlegal team joined the process and filed an official claim, the shipowner engaged P&I Club in negotiations.
Interlegal lawyers and P&I Club representatives held several rounds of negotiations, whereunder P&I Club tried to delay the recovery process.
Interlegal lawyers prevented such a delay by means of arresting the vessel involved in damaged cargo transportation.
Ship arrest was an impulse for starting active negotiations which resulted in P&I Club guarantee amounting to 1.3 million USD, aimed to cover all the losses incurred by the Client.
Claims handling and ship arrest once more were confirmed as working mechanisms of dispute pretrial settlement.
In case of facing a similar situation, it is important to fix correctly cargo damage and to engage promptly experts in order to commence negotiations and to make a decision on claim security (including by means of ship arrest).
If necessary, Interlegal experts will be ready to provide prompt legal advice upon taking the required measures, jointly with legal support of damage recovery.
Interlegal lawyers Mykola Kozachenko & Nikita Kocherba, associate attorney Vitalii Tolstik, managed by senior associate Karyna Gorovaya, led the case.
