Interlegal recognized LMAA award in Kazakhstan

The client – large shipowner filed a request to Interlegal on recognition and enforcement of LMAA arbitral award on charging demurrage from the Charterer due to exceeding the arranged laytime.
According to the Arbitration Clause, the London Maritime Arbitrators Association (LMAA) settled the dispute and issued an award on charging demurrage from the Charterer in favour of the Shipowner.
Pursuant to 1958 New York Convention, procedure upon LMAA award recognition was held under the Defendant’s location, i.e. at the territory of Kazakhstan.
Interlegal lawyers, jointly with our associated office in Kazakhstan – UNICASE Law Firm performed a complex work upon analysis of documents, drafting documents to be submitted to the court, collecting evidence, drafting legal opinion, followed by filing an application to the local court on recognition of arbitral award.
Having studied case materials, having assessed evidence and the Client’s opinion, the court made a ruling on satisfying the application and obliging the Charterer to pay indebtedness to the Client irrevocably, jointly with all the expenses borne by the Client in the process of arbitration proceedings.
