However, a victory in arbitration is only the first step towards protecting the client’s rights. It is equally important to secure actual enforcement of the arbitration award.
In this case, the buyer initially considered an option to contest the GAFTA award and tried to impact on the seller in order to reduce the awarded reimbursement amount. However, thanks to clear legal position formulated at the arbitration stage and a carefully developed negotiation strategy, we managed to secure enforcement of the award without long-term egal proceedings.
The buyer acknowledged the lack of prospects for an appeal, rejected initiating the appellate proceedings and agreed to enforce voluntarily the arbitration award, namely to pay 200,000 USD.
This case once again confirms that highly qualified legal support is crucial not only for successful arbitration protection, but also for actually achieving a result – actual enforcement of the award.
