Expert report described in details the provisions of Ukrainian law concerning rights of legal holders of the Bearer Bills of Lading, in particular the right to claim against the carrier. Additionally, the carrier’s responsibility arising out of breach of the contract of carriage by sea or out of law has been analyzed.
In such a way, the High Court of Singapore is able to apply provisions of the Ukrainian substantive law in settlement of the dispute arising from the contract of sea carriage of agricultural products originated from Ukraine.
