Interlegal team helped the Charterer to charge losses upon cargo shortage

The Charterer applied to Interlegal upon the trade contract, based on cargo shortage at the discharge port and the Buyer’s failure to pay cost of the missed part of goods. The Charterer imposed liability for shortage on the Shipowner.
At the loading port cargo holds were sealed in accordance with the Charter Party, however at the discharge port cargo holds were unsealed in the absence of representative duly nominated by the Charterer. Therefore, the Charterer was entitled to charge losses under the Charter Party from the Shipowner who violated terms of the Charter Party upon unsealing procedure.
Following several stages of correspondence on sharing opinions and several phone conversations with the Shipowner and its representatives, Interlegal lawyers justified their position under the case and persuaded the Shipowner to reimburse the appropriate losses incurred by the Charterer.
