Maritime Arbitration Commission at the Chamber of Commerce and Industry of the Russian Federation (MAC at the CCIRF) 

Maritime Arbitration Commission at the Chamber of Commerce and Industry of the Russian Federation (MAC at the CCIRF) has been established as independent and permanent arbitration body operating at the Chamber of Commerce and Industry of the Russian Federation in accordance with the Law of the Russian Federation “On international commercial arbitration” and the approved Rules.

Alongside with the Rules, there was approved the List of MAC arbitrators which includes the leading lawyers, recognized experts and scientists in maritime law and international merchant shipping. There are both Ukrainians and citizens of other states. In the process of initiating arbitration proceedings arbitrators shall be appointed either by the parties or by President of the Chamber of Commerce and Industry of the Russian Federation.

 

Statute and Rules of MAC at the CCIRF

While settling disputes, arbitrators refer to the Statute and Rules of MAC at the CCIRF. Statute of MAC at the CCIRF is set forth in Supplement II to the Law of the Russian Federation “On international commercial arbitration”.

Rules of MAC at the CCIRF were approved by the Order of President of the Chamber of Commerce and Industry of the Russian Federation dd. the 21st of December 2006. Its valid wording contains amendments and modifications made by the Order of President of the Chamber of Commerce and Industry of the Russian Federation No. 132 dd. the 27th of December 2011.

 

Disputes to be settled by MAC at the CCIRF

MAC competence covers settlement of disputes arising in the process of commercial and civil relationship, in particular, concerning merchant shipping.

Arbitration settles disputes regarding vessel chartering, sea and multimodal cargo transportation, towage and maritime insurance, vessel sale and purchase, lien and repair, pilotage and ice-breaking, salvage and collision at sea, agent and other services for sea-going vessels, scientific, research and other sea works as well as disputes arising from other relationship, including adjacent, within the arbitration competence under contract or agreement.

 

MAC at the CCIRF advantages against other arbitration institutions

  1. MAC at the CCIRF settles disputes irrespective of the fact, whether subjects of the dispute are both Russian and foreign entities or either Russian or foreign entities only.
  2. All the case materials, award and details of the parties are deemed as confidential information.
  3. The President is entitled to make a decision on claim security including in the form of order on ship or cargo arrest, if their location at the Russian port is known.
  4. Arbitration language shall be Russian. The parties are entitled to agree any other arbitration language.
  5. Arbitration at MAC at the CCIRF shall comply with law provisions selected by the parties as applicable to subject of the dispute.
  6. MAC at the CCIRF awards shall be final and enforced by the parties voluntarily. Under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958, MAC at the CCIRF awards shall be recognized and enforced at the foreign jurisdictions.
