Maltese company – a shipowner whose vessel was berthed at the Reni Commercial Sea Port – applied to Interlegal, based on losses incurred due to maritime accident caused by cargo motor vessel owned by Romanian company.
Such circumstances are typical of the Bosporus but are quite unique for Reni sea port water area: cargo motor vessel rapidly changed her course towards the Client’s vessel and therefore caused collision and dent in the latter’s board. When application was filed to Interlegal, the Client’s representatives had taken some measures regarding accident, namely fixed the case by Master’s Note of Protest and estimated repair works in the amount of 150,000.00 USD as per ship repair yard tariff.
The parties chose several spheres of works – each of them gained results. First, they decided to apply to the Harbor Master on vessel detention; therefore, for three days the vessel was unable to leave sea port water area and the territory of Ukraine, having facilitated for our law team additional term to process one more scope of works.
Under the first works results, Interlegal law team applied an effective instrument in the form of filing a lawsuit to the court. The latter supported the Client’s position and arrested the vessel, having prohibited the Harbor Master to grant permission on leaving sea port.
Later, there were some nuances in the project – like screenplay in the Hollywood blockbuster (unfortunately): we’ll be back!
Interlegal associated attorney Taras Dragan, lawyer Karina Shakhbazian, junior lawyer Mariia Kalashnikova, managed by associate partner Karyna Gorovaya, are leading the case.
