Interlegal Ukrainian and Romanian offices completed successfully the

Previously, the Client – leading insurance company specialized in risk insurance during cargo transportation applied to Interlegal for damage recovery as subrogation.

Interlegal Romanian office represented by partner Virgil Nita initiated court proceedings in Romania which resulted in full satisfaction of the Client’s claims, despite the Defendant’s resistance and all the attempts to delay proceedings.

Court decision served as grounds for initiating enforcement proceedings, whereunder the Client rejected voluntary enforcement of the decision. The Defendant tried also to delay enforcement proceedings, having applied to the court allegedly that the decision was not delivered lawfully to the Defendant’s office and therefore it was entitled to appeal against.

Due to initiating court proceedings, enforcement proceedings have been suspended until making a decision on the merits. Having studied case materials, the court rejected satisfaction of the Defendant’s claim, followed by renewal of enforcement proceedings.

Due to the Defendant’s behaviour, it was decided to apply all the possible instruments for damage recovery. As soon as Interlegal lawyers initiated arrest of the Defendant’s accounts, the latter applied for amicable dispute settlement. In a week, the Defendant enforced voluntarily the decision and reimbursed damages in full.

Interlegal Romanian partner Virgil Nita, Ukrainian senior associate Karyna Gorovaya and Ukrainian lawyer Irina Yakimovskaya led the case.
