Lawyers of Interlegal protected interests of sunflower oil owner in Commercial Sea Port Yuzhny
The basis for the decision on cargo reexamination was an investigation held by the Investigation Department of Financial Investigations of the State Tax Service of Ukraine of one of the districts of Kiev in the criminal proceedings under the Article 205 of the Criminal Code of Ukraine (fictitious business) and the Article 212 of the Criminal Code of Ukraine (evasion of taxes, fees) against one of the suppliers of Ukrainian sunflower oil.
Taking into consideration that this supplier was an exporter of the goods purchased by the Client from a foreign company, very significant risks of seizure or cargo confiscation came up in the criminal proceedings.
Interlegal lawyers promptly provided the investigators of the Investigation Department of Financial Investigations of STS with all necessary documents that confirmed the Customers goods ownership and proved the fact of purchase of property rights of the Customer for the cargo in full compliance with the Ukrainian legislation.
After consideration of the documents and analysis of the arguments of inadmissibility to violate the rights of the rightful owners, the investigators of the Investigation Department of Financial Investigations of STS could not find any legal grounds for preventing further shipment of the goods for export. As a result the cargo was successfully loaded on the vessel and sent to its foreign buyer.
