Interlegal Client for year and a half was unable to recover from the Shipowner the debt upon bunker and oil supply.
For the whole period the parties held ineffective negotiations while the Shipowner evade its duty.
The Client had to apply for defense of violated rights. Interlegal lawyers drafted the legal opinion and filed an application to the court on ship arrest due to the arisen maritime claim. The court accepted arguments and the vessel was arrested at one of the Ukrainian sea ports.
Having assessed legal effects of further court proceedings, the Shipowner made a decision on pretrial dispute settlement and paid voluntarily full debt against the Client.
Having settled the dispute, Interlegal lawyers immediately took measures aimed at vessel release, so the Shipowner could avoid losses.
The above case shows once more that sometimes successful dispute settlement requires additional arguments such as the Debtor’s property arrest.
Interlegal senior lawyer Alexey Remeslo and lawyer Vitalii Tolstik led the case.
