Tax Risks in Ukraine for Non-Resident

Interlegal specialists prepared a legal opinion analyzing the tax risks and corporate structure of the Client’s business. This included assessing risks related to the recognition of a permanent establishment in Ukraine and the place of effective management in Ukraine.
Recommendations were provided to address tax risks and update the corporate structure of the business.
Additionally, an analysis of the Client’s tax residency was conducted in relation to the rules governing Controlled Foreign Companies (CFC). Interlegal lawyers concluded that the Client is a tax resident of Ukraine and, as such, is required to submit CFC reports for the 2022 and 2023 reporting years by May 1, 2024.
As a result, the Client received comprehensive answers to a wide range of questions related to tax risks for a company engaged in international business.
