Interlegal at the All-Ukrainian Scientific Practical Conference of the Ukrainian Commercial Court Judge Association

On 19.05.2017 the All-Ukrainian Scientific Practical Conference “Principal innovations of the draft Commercial Procedural Code of Ukraine and prospects of their application in court practice” based on the Odessa Commercial Court of Appeal.

Comprehensive discussion touched theoretical and practical aspects of applying the draft Commercial Procedural Code and facilitated revealing authors’ successful and problematic ideas and making proposals upon their elimination.

Commercial court judges, scientific society representatives and practicing lawyers participated in the conference.

To draw attention of the law community to the draft Commercial Procedural Code provisions regulating ship arrest, Interlegal lawyers participated in the discussion devoted to the claim security institute.

In particular, they made their own opinion concerning progressive draft Commercial Procedural Code provisions in respect of filing claims to commercial courts and arbitrations and eliminating proportionality provisions. Special attention was drawn to necessity in amending the provision upon exclusive jurisdiction of such case category by adding the data about ship arrest opportunity in respect of vessels calling at terminals located outside the port water areas and at river ports.
