Judicial practice in railway cargo transportations

Department of the Ukrainian Bar Association in Odessa and the Transport Committee of the Ukrainian Bar Association held the joint session on the topic Judicial practice in railway cargo transportations and transport forwarding on the examples of Case Study on the 22^nd of February in Odessa.

The session was moderated by:

Mr. Artem Volkov, senior lawyer of ANK Company, Head of the Transport Committee of the Ukrainian Bar Association

The lawyers Artem Volkov (ANK), Artem Skorobogatov (Interlegal), Aleksandr Chebotarenko (Interlegal), Karina Gorovaya (Interlegal), Maxim Kapelist (Yurline), Maxim Kocherzhenko (Kocherzhenko and Partners), Oleg Milchenko (Arzinger), Yelena Nechitailo (Yuzhnyi Commercial Sea Port), Mariana Maruschak, Irina Dobrokhod, Denis Siyushov and others took part in the session.

The lawyers shared their experience regarding compensation of damages and settlement of claims arisen on cargo railway transportations. In particular, they discussed the mechanisms of detecting and proving the facts and causes of cargo damage and short of delivery, possibilities of cargo insurance and railway forwarders’ responsibility, regressive recovery of damages from the railway etc.
