Defense of the Client’s interests against the Panama Maritime Authority

Imagine the situation concerning failure of radio equipment on board of the vessel registered under the Panamanian flag. For that reason, it was impossible to report on the vessel location which resulted in penal sanctions. What should we do?

Some rules prescribe an obligation for all the vessels flying under the Panamanian flag: they shall report on their location and route by means of identification system. In case of failure to submit such data, the shipowner (or the charterer) may pay fine in especially large amount.

Recently Interlegal lawyers defended interests of our regular Client (owner of vessels registered under the Panamanian flag) against the Panama Maritime Authority.

One of the Client’s vessels had unsound radio equipment; therefore, it was impossible to identify her location. In resulted in the investigation process.

Our lawyers received documents certifying the vessel’s exact location and the fact of unsound equipment. Based on such evidence, the Client was able to avoid fine amounting to 10,000 USD and to win the case proceedings.
