Fresh news by Interlegal: one of the most interesting latest ship arrests!

Let us remind: A Cypriot company filed to Interlegal a request on ship arrest. The Client was a fish owner (bred by a Cypriot fish farm). Just two years ago, tanker accident resulted in destruction of fish cages and equipment.

Last time, the court rejected to satisfy the opponent’s appeal. For that period, we faced good and bed news. Now we are dealing with cassation instance.

Having disagreed with results of considering an appeal, the opposing party contested both first instance and appellate court judgments at the cassation instance.

Having studied evidence and arguments of both parties, the Supreme Court not only supported our Client’s position but also made innovative statement. Since the opposing party argued that ship arrest was unlawful just for the reason of re-arresting the vessel, the Judicial Board had an opposite position.

The court fixed quite a simple basic rule: in case of unsuccessful applying to the court upon ship arrest, you may do it for many times until you reach a success (of course, if you have sufficient grounds).
