Interlegal law team won the court dispute amounting to $1,200,000

The Client – shipowner applied to Interlegal regarding prospects for appeal against the first instance court decision, in order to receive insurance indemnity amounting to $1,200,000.

During one of the voyages, the Client’s vessel engine got damaged. Since the vessel was insured, the Client applied to insurance company for insurance indemnity. However, insurance company did not recognize it as insurance event and rejected payment of insurance indemnity, so the Client had to apply to the court. Under the results of case consideration, the first instance court stated that insurance company lawfully rejected payment of insurance indemnity.

Having studied promptly primary documents and case circumstances, jointly with correct legal assessment, Interlegal lawyers detected the grounds for cancelling the first instance court decision and form making a new decision on satisfying the Client’s claims in full.

Further, the court of appeal fully supported Interlegal position.

After the court of appeal made an award, Interlegal law team held negotiations with the insurance company and provided legal support for voluntary enforcement of judicial award.

Finally, insurance indemnity for vessel engine damage amounting to $1,200,000 was remitted to the Client’s bank account.

Interlegal senior associate Karyna Gorovaya, associate attorney Vitalii Tolstik and lawyer Nikita Kocherba led the project.
