Interlegal lawyers consulted the client upon currency control

A large Ukrainian exporter applied to Interlegal upon the option to avoid violation of deadlines upon export operations. As per the Client’s request, its counteragent failed to pay for supplied goods within the term agreed by the parties, so the exporter faced high risks of deadline violation and accrual of penalties.

Having analyzed in detail the situation, all documents, Ukrainian legislation and court practice, Interlegal lawyers stated that the Client had several options to solve the problem, such as return of goods in Ukraine, initiating criminal proceedings at the destination country and filing arbitration claim on debt recovery under the contract. Interlegal also obtained information about status of goods at the destination country and proceeded in detail each option, indicating its pros and cons.

In case of similar situation, we will be glad to assess available ways of solution, jointly with granting practical recommendations: how to avoid violation of deadline for settlements upon export operations and how to choose the most optimal way of solution.
