Interlegal lawyers settled discrepancies under the sunflower oil supply contract

The Client – Chinese company – applied to Interlegal for legal advice upon performance of the contract on Ukrainian sunflower oil supply. The Ukrainian supplier refused to perform the contract, with reference to alleged lack of production. With regards to the vessel engaged by the Buyer for loading, one of her crew members was diagnosed with a suspicion of COVID-19, so the vessel could not file Notice of Readiness in due time.

Interlegal lawyers analyzed all the documents, including contract between the Seller and the Buyer, which was governed by English law and incorporated FOSFA proforma.

As a result, we have reasonably proved that, despite delay in filing Notice of Readiness, the Buyer duly fulfilled its contractual obligations. We also developed a clear legal position and provided to the Buyer step-by-step action plan for interacting with the Seller. Under the guidance of Interlegal lawyers, the Client was able to provide to the Seller indisputable reasons, whereunder it was forced to find the product and to perform the contract.
