Interlegal Ukrainian and Turkish offices jointly defended the Bulgarian company rights

The Client – large Bulgarian company in top-100 Bulgarian companies engaged in supply, manufacturing, storage and wholesale trade, applied to Interlegal. The Client also owns a multifunctional terminal based on railway, road and water carriages.

As railway operator, the Client rendered services to the large Turkish company upon cargo transportation by rail (from Istanbul to Vienna), in due time and to the full extent. Since the counteragent delayed payment, the Client took measures aimed at blocking the counteragent’s trains, followed by partial debt recovery. Later the counteragent neither contacted nor repaid indebtedness in full.

Due to the counteragent’s unfair behaviour and impossibility to settle amicably the dispute, the Client filed a request to Interlegal on legal assistance upon the remaining debt recovery, jointly with relevant losses and expenses.

In order to achieve the goal, Interlegal Ukrainian and Turkish offices simultaneously processed the Client’s request. Their joint services included Due Diligence of the Debtor in order to determine property being subject to foreclosure, as well as Claims Handling aimed at amicable dispute settlement and saving the Client’s costs for court proceedings, but the counteragent still ignored the Client’s claims.

In order to solve the problem, Interlegal lawyers initiated enforcement and court proceedings under the Turkish legislation, which resulted in offers upon debt recovery but did not result in the counteragent’s active actions. With regards to absence of the Client’s real estate and the Client’s weekly cargo transportations between Vienna and Istanbul, Interlegal lawyers initiated seizure of funds deposited and remitted to the counteragent’s account, amounting to half of indebtedness.

Last week the Turkish court made a decision on satisfying the Client’s claims in full and charging fine for the counteragent’s unlawful objections against the claim.

Now, Interlegal lawyers have completed one of the stages of case proceedings. The remaining debt recovery is still under proceedings. See the next news for announcement of the final result.
