Shipowners may refund costs, paid unlawfully to USPA

Decision of the Antitrust Committee of Ukraine (case No. 910/1106/20) entered into legal force, and now shipowners are free to defend their legal interests under disputes with USPA upon recovery of unlawfully paid costs.

Decision of the Antitrust Committee of Ukraine recognized that in 2017-2018 State Enterprise “Ukrainian Sea Ports Authority” violated the legislation on safety of economic competition.

In particular, such violations concern:
- accrual and charging from shipowners additional costs for registration of vessel arrival to sea ports;
- accrual and charging from shipowners additional costs for registration of vessel departure from sea ports;
- accrual and charging from shipowners additional costs for vessel inspection for compliance with ISPS regulations;

Therefore, due to entry into force of the Decision of the Antitrust Committee of Ukraine, shipowners are free to charge double amount of all costs paid by SE “USPA” in 2017-2018.
